| | Risk is a fact inherent and inevitable in any large construction project. It is
impossible to imagine a construction contract without risk, where there is certainty about scope, time and cost. A construction contract is unique in that it attempts to provide a specific remedy in the event of any breach and/or for an entitlement in respect of specified events or identified risks. However, an obligation is placed on the party who wishes to make use of that remedy to follow a set procedure, namely the claims procedure. |
